These Terms of Service (“Agreement”) govern your access to and use of services provided by PorterYachts LLC, located at 5626 Monroe Street, Hollywood, FL 33023 (“PorterYachts,” “Company,” “we,” or “us”). By using PorterYachts’ services (the “Service”) or accessing any part of the PorterYachts website or online platform (the “Platform”), or engaging our services (“Service”), you agree to be bound by this Agreement, including any future modifications.
By accessing or using the Platform or Service, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you may not access the Service or Application.
PorterYachts reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service constitutes acceptance of the updated Terms.
PorterYachts acts as a charter agent, arranging yacht charters through communications by email, text, phone, website, or Application. It is your responsibility to review and verify all booking details before confirming a reservation. Acceptance of a booking confirmation constitutes acceptance of this Agreement and PorterYachts’ cancellation policies.
Charters are subject to the terms of a separate Charter Agreement, which governs specific details of the charter including vessel use, payment, cancellations, and conduct.
To make a reservation, you must create an account and provide a valid credit card or approved payment method.
Reservation Deposit: For bookings confirmed more than 7 days in advance, a non-refundable deposit equal to the greater of $1,000 or 50% of the total charter price is required at the time of booking.
Final Payment: Remaining balances must be paid no later than 7 days prior to the charter date.
Late Payments: Unpaid balances are subject to a 1.5% monthly interest charge or the maximum rate permitted by law. You are responsible for all collection costs, including reasonable attorneys’ fees.
Promotional offers are at PorterYachts’ discretion and will not alter the terms of any existing booking unless explicitly stated in writing.

These expenses will be added to your final invoice and charged to the payment method on file.
All passengers must comply with U.S. Coast Guard and applicable government regulations, providing valid identification prior to boarding. For international charters, valid passports and any necessary visas are required.
Failure to comply may result in denied boarding without refund.
Clients must arrive at least 30 minutes prior to departure. If you are not present within one hour of the scheduled departure time, the charter will be deemed missed and charged in full. PorterYachts may attempt to reschedule at additional cost, subject to availability.
PorterYachts is not liable for cancellations, delays, or failure to perform resulting from causes beyond our reasonable control, including but not limited to:
In such events, PorterYachts will use reasonable efforts to reschedule or arrange alternative services. Liability is limited to amounts paid by you for the affected charter.
You are responsible for any damage caused to the yacht, its furnishings, or equipment by you or your guests. Repair costs will be charged to your payment method on file
All yachts are independently owned and operated. PorterYachts is not responsible for accidents, losses, or damages arising from vessel operations.
You agree to use the Application lawfully and will not:
You grant PorterYachts a non-exclusive, royalty-free license to use, reproduce, and display any content you submit through the Service for operational purposes.
The Service may provide access to third-party providers. PorterYachts is not responsible for third-party services, and all disputes must be resolved directly with the provider.
Any disputes will be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Waiver of Class Actions: You agree to resolve disputes individually and waive the right to participate in class actions.
Location: Arbitration will occur in the county of your residence or another mutually agreed location. Governing Law: Florida law governs this Agreement.
The Service is provided “as is” without warranties of any kind, express or implied. PorterYachts disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
PorterYachts is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless PorterYachts, its officers, employees, and agents from any claims, liabilities, damages, or expenses arising out of your violation of this Agreement or your use of the Service.
PorterYachts may provide notices via email, postal mail, or updates to the Application.

You may not assign your rights or obligations under this Agreement without prior written consent from PorterYachts.
PorterYachts may freely assign this Agreement in the event of merger, acquisition, or sale of assets.
This Agreement constitutes the entire agreement between you and PorterYachts regarding the Service. If any provision is found invalid, the remaining provisions shall remain enforceable.
The failure of PorterYachts to enforce any right under this Agreement does not constitute a waiver of that right.
